DH - Information note

The DH produced an information note on cases of exceptional circumstances and compensatory rest for the European Working Time Directive. Although the Jaeger case did not define what would amount to an exceptional case this note aims to outline potential circumstances and examples for the NHS. However, trusts must use their own judgment, informed by their own legal advice, based on particular local circumstances in deciding whether an exceptional case exists.
